Right of Withdrawal

If you are a so-called "privileged buyer"—that is:

A) a consumer

or

B) a natural person for whom the contract concluded with us is directly related to your business activity but is not of a professional nature for you

—you generally have the right to withdraw from the distance contract.

You may withdraw from the contract by submitting a statement of withdrawal to us, for example, via an email sent to: kontakt@sirkahandmade.pl.

You may withdraw from the contract within 14 days.

The fourteen-day withdrawal period begins when you, or a third party other than the carrier and indicated by you, take physical possession of the goods; in the case of a contract covering multiple goods delivered separately, in batches, or in parts, the period begins when you take physical possession of the last good, batch, or part.

To meet the deadline, it is sufficient to send the statement before the period expires.

Please return the goods to us promptly at the following address: ul. Jana Nowaka Jeziorańskiego 12/194, 03-984 Warsaw, but no later than 14 days from the date on which you withdrew from the contract.

We will refund the payments made by you promptly, in accordance with the rules set out in the Store Regulations, but no later than 14 days from the date we receive your statement of withdrawal.

Unless we have offered to collect the goods from you ourselves, we may withhold the refund of the payment received from you until we receive the goods back or until you provide proof of having sent them back—whichever occurs first. Please note that you do not have the right to withdraw from a distance contract regarding, among others, a contract:

for the supply of non-prefabricated goods made to your specifications or clearly personalized;
for the supply of goods liable to deteriorate or expire rapidly;
for the supply of sealed goods which are not suitable for return due to health protection or hygiene reasons and were unsealed after delivery;
for the supply of audio or video recordings or computer software in sealed packaging, if the packaging was unsealed after delivery.

Complaints

The following information applies to a so-called "privileged buyer." If you do not fall into this category, please consult our Store Terms and Conditions for detailed information regarding complaints.

If we fail to properly perform the contract concluded with you, you have the right to file a complaint—preferably via email at kontakt@sirkahandmade.pl or by mail to the address: ul. Jana Nowaka Jeziorańskiego 12/194, 03-984 Warsaw.

As a general rule, we are liable for any lack of conformity of the goods with the contract that exists at the time of delivery and becomes apparent within two years of that time.

Under the provisions of the Consumer Rights Act, in such a situation, you may request:

a) replacement of the goods

or

b) repair of the goods. In certain cases, you may also:

a) withdraw from the contract

or

b) submit a declaration reducing the price
